Jimmy Fallon Denies Link to BAYC Lawsuit, Files to Quash Subpoena

Straighten your wigs, because today's newsletter is full of NFT law. Firstly, late-night talk show host Jimmy Fallon has found himself caught up in a legal battle involving Bored Ape Yacht Club NFTs.
 
The talk show host is caught up in the Yuga Labs Ryder Ripps case (aka mess), in which Yuga Labs are taking legal action against RR/BAYC for trademark infringement. Fallon has been called to testify.

However, Fallon's lawyers have filed a request to quash a subpoena demanding his testimony.

The Yuga Labs vs. Ripps case revolves around allegations of trademark infringement, false advertising, and unfair competition related to a "copycat" NFT collection. Fallon's legal team argues that he has no involvement in the case and should not be required to testify.

Unfortunately for him, this is not the only BAYC legal case he is a part of. Fallon is also a co-defendant in a securities litigation case involving Yuga Labs along with Paris Hilton and other celebrities. A class-action lawsuit has been filed against BAYC NFT founders, alleging that they promoted the NFTs in a misleading manner and caused significant financial losses for buyers.

Some have criticized Fallon for not doing his due diligence before endorsing the product, while others argue that the responsibility falls on the companies themselves, not on celebrities and influencers.

The moral of the story? The NFT space is rapidly evolving, and clear regulations and standards are needed to navigate the legal and ethical factors inherent in NFT transactions.

Hermès Seeks Complete Control of MetaBirkin NFTs and Royalties

Order in court! We are now moving on to case two.

Luxury fashion brand Hermès just won’t give up on their feud with artist Mason Rothschild over the MetaBirkins NFT collection. First, they sued him for violating their Birkin trademark, then they settled for $133,000 in damages.

Now, they want the whole project shut down, including smart contracts and social media NFT communities.

Hermès is even asking Rothschild to transfer everything related to MetaBirkins to them. Rothschild’s lawyer claims it’s a “gross overreach” and that Hermès is punishing him because they don’t like his art.

In case you’re wondering, MetaBirkins is a collection of 100 limited-edition NFTs featuring Hermès-inspired handbags, and it’s been causing drama since December 2021.

So, it seems like the feud between these two isn’t going away anytime soon. Maybe Rothschild can create an NFT of the court documents and sell it for more than the settlement amount.
